Boat berths

1. The boat mooring agreement comes into effect upon payment for the boat mooring. The rental agreement is valid until the end of the year.
2. The boating season is from May 1.5 to November 30.11. However, the length of the boating season may vary depending on weather conditions.
3. The renter and the owner of the boat must be the same person. The rental right may not be transferred or subleased.
4. If the rent for the previous boating season has not been paid, the city has the right to terminate the lease agreement.
5. The rental fee will not be refunded if the agreement is terminated during the rental period.
6. If the renter changes the boat berth to a more expensive one during the boating season, he or she will have to pay the difference in the price of the boat berths. If changing to a cheaper berth, the difference will not be refunded. The berth can be changed at the City of Hamina service point in Rinkeli.
7. The city is not responsible for vandalism or theft of boats, or for damage occurring in marina areas.
8. The boat may only be moored at the rented location. The city has the right to remove a boat in an unauthorized location from the city's land or water areas and store it at the owner's expense and responsibility.
9. If the city needs to carry out repairs and renovations to the boat docks during the boating season, another suitable location may be assigned to the boat.
10. The changed contact information of the berth holder must be updated in the booking service or notified to the City of Hamina customer service point, Rinkeli. The berth holder must also notify if the boat placed in the berth has been replaced with another one.
11. The renter must ensure that the boat fits securely in the reserved spot. The boat must be secured carefully. The use of fenders is recommended.
12. Storing boats and equipment on the pier is prohibited.
13. Placing car tires and other equipment on boat booms or the edge of piers is prohibited without a city permit.
14. Necessary caution must be exercised in the marina area. The city is not responsible for damage occurring in the marina areas and on the piers, unless it is caused by the city's negligence.
15. Garbage and waste must be delivered to these designated areas or taken away upon departure.
16. The tenant must report any defects and deficiencies they notice in the port areas to the city's green services or the Rinkeli customer service.
17. Dock electricity is not intended for use with electric heaters or other high-power-consuming applications.
18. If the tenant violates the rental terms, the city has the right to terminate the rental agreement. In this case, the rent paid will not be refunded.
19. Compliance with the rental terms and conditions is monitored by the Green Services of the City of Hamina.

Section 1 General
1.1. Concepts
Port
When the term "harbour" is used in these marina regulations, it refers to the marinas of the city of Hamina.
Harbourmaster
The harbour manager refers to the regional services of the City of Hamina or the boat club and similar operators renting the harbour.
1.2. The small boat harbours listed in Appendix 1 operate under the authority of the City of Hamina. The berths in the marinas are owned by the city, but some of the berths are managed by boat clubs. The maintenance of the marinas is carried out by the Regional Services of the City of Hamina and the marina fees are determined according to the valid fee list (Appendix 2).
1.3. The regional services of the City of Hamina and the security company contracted by the city will be responsible for guarding the marina area of ​​the City of Hamina.
1.4. The marina rules apply to all marinas owned or managed by the City of Hamina, as well as to winter and storage areas for boats. The boundaries of the marina areas, including dock areas and winter storage areas, are marked on the maps attached to these marina rules (Appendix 1).
The City Engineer of the City of Hamina has the right to supplement and update these marina rules and attached maps as necessary. Up-to-date marina rules are available on the City of Hamina website or by contacting the green services. In addition, marina rules are available at marinas.
1.5. In the water areas, marinas and marina areas of the City of Hamina, the current provisions of the Water Traffic Act (782/2019), the Environmental Protection Act (527/2014), the Waste Act (646/2011), the Waste Decree (978/2021), the Chemicals Act (599/2013), as well as municipal environmental protection and waste management regulations must be complied with. In addition to this marina regulation, separate permanent regulations specific to the port or storage area may be issued, supplementing these regulations.

Anyone who rents a boat berth, trailer berth and/or winter storage space from the city or otherwise operates in the city's marina or boat storage areas must comply with these rules.
1.6. The owner of a water transport vessel must provide the regional services of the City of Hamina with all information necessary for the safety and functionality of the marina and for charging berth fees.
1.7. All commercial activities must be reported to the City of Hamina according to a separate contact list. The contact list is in Appendix 3 of these Port Regulations.
Section 2 Safety
2.1. In the port, the speed of vessels must be adjusted on a situation-specific basis in the water area so that it does not cause danger, inconvenience or damage to other marina users, the marina or its equipment, or the vessel itself.
2.2. Firefighting, rescue and first aid equipment and devices in the port area may only be used for their intended purpose.
2.3. Warning signs, fences or other signs set up by the City of Hamina or the security company may not be moved or removed without their consent. Unauthorized presence in the isolated marina area marked with a fence or prohibition sign is prohibited. The rules and regulations drawn up by the City of Hamina or the security company must be followed in the marina area.

2.7. Competitions organized in marina areas or fairways managed by the City of Hamina always require a permit from the City of Hamina's regional services.
2.8. Swimming in harbor pools and boat lanes is prohibited.
2.9. The City of Hamina or the security company will report all suspected crimes to the police for processing. The operators must notify and appoint a contact person for handling security matters when signing the lease agreement.
Section 3 Loading, unloading and storage of goods
3.1. When unloading and loading goods, care must be taken to ensure that the quay structures and city equipment are not damaged.
3.2. Goods may not be left on quays, streets, corridors, warehouse shelters, stairs, on fire hydrants, in front of life-saving appliances or anywhere else where they obstruct traffic, except with the permission of the port authority in each exceptional case.
3.3. Transport and auxiliary equipment used in the transfer of goods, as well as other loose equipment, must be removed or assembled at a location designated by the port authority after use. Work machines must not be left in the quay area after work is completed.
3.4. When leaving goods in the quay and port area for a longer period of time, the instructions given by the port authority must be followed.
3.5. Goods must not be stored in a way that obstructs traffic or the use of rescue or firefighting equipment.
Section 4 Environmental regulations
4.1. The ship owner shall ensure that the ship does not leak, pump or discharge oil, chemicals, waste or other polluting substances into the water or the environment. The ship owner shall also ensure that the ship's operations do not otherwise cause unreasonable harm or danger to the environment or other users of the marina.
4.2. All wastewater from all vessels, including sauna and apartment boats, must be collected in a sealed container, which is emptied into the marina's septic system.
4.3. The ship owner must immediately notify the port authority of any oil, chemicals, waste and other pollutants that have entered the water or the environment, take measures to remove them and, if necessary, contact the rescue authority.
4.4. Care must be taken to ensure that the marina is not unnecessarily polluted and that unnecessary noise is not caused. The harbour operator may suspend activities that are harmful to the environment. The shipowner must ensure that garbage, waste and tarpaulins are taken to the designated places and that contaminated areas are cleaned. In waste handling and

4.5. Repair and renovation work that may cause dirt, subsidence or a fire hazard may only be carried out with the permission of the harbourmaster and in a separately designated place. If the work causes harm to the operations of the marina, it must be suspended at the request of the harbourmaster.
4.6. Garbage and waste must be taken to the places designated by the port authority and the places soiled by the work must be cleaned. Otherwise, the port authority may have the cleaning work carried out at the expense of the person causing the pollution.
4.7. All activities taking place in the marina must take into account the environmental protection regulations in force at any given time and comply with the regulations insofar as they apply to one's own activities.
4.8. Companies and associations operating in the marina must comply with separate regulations issued based on the terms of the environmental permits in force at any given time.
4.9. The regional services of the City of Hamina also have the right to arrange periodic inspections to check the condition of vessels, if there are grounds for doing so.
Section 5 Renting a boat berth
5.1. The subject of the rental agreement is a boat, winter storage or trailer space designated by the City of Hamina or a boat or winter storage space designated by a boat club.
5.2. A tenant who carries out commercial activities (e.g. café or restaurant ships) in or based on the marina must present a vessel damage and liability insurance before the lease agreement is concluded. The insurance must cover the costs arising from the sinking and relocation of the vessel. The damage and liability insurance must be valid continuously for the entire duration of the lease agreement. Once the damage and liability insurance has entered into force and by subsequently accepting the berth, the tenant accepts the marina rules and undertakes to comply with all instructions and regulations given. An approved berth is the same as the lease agreement.
5.3. The lessor is Hamina Regional Services or a party authorized by it.
5.4. The tenant may be a private person, a company or an association engaged in maritime activities that has entered into a rental agreement with the regional services of the City of Hamina. The tenant must be the owner or holder of the boat kept at the berth.
5.5. The fees are decided annually by the regional services of the City of Hamina. The price list is available on the city's website: https://hamina.venepaikat.fi/ and as Appendix 2 to these marina rules and is updated annually. The fees are always announced in December of the previous year.
5.6. The tenant may not transfer the lease agreement or hand over his/her berth to a third party, even temporarily. Violation of this prohibition shall result in immediate loss of the berth. Upon the tenant's death, his/her beneficiary shall have the right to have the lease agreement transferred to him/her, provided that the beneficiary meets the conditions set for the tenant.

5.7. The City of Hamina has the right to terminate the lease agreement immediately if the tenant does not pay the marina fee or other fees imposed on him or her or does not comply with the law, these marina rules, or the instructions or requests given by the landlord. The reservation of the berth, the lease agreement and the right of use will be terminated if the payment is not received by the due date announced by the City of Hamina to the City of Hamina account.
The due date is unconditional. After this, if the contact person named in the rental agreement cannot be reached within a reasonable time through the authorities, the lessor has the right to move the boat away from the berth at the boat owner's expense. The move date is the recovery date.
5.8. If the owner of the boat cannot be reached and no one registers as the owner of the boat, the boat will be stored at the location indicated by the lessor for 12 months, including the transfer date, after which the boat can either be sold or scrapped. The regional services of the City of Hamina may also terminate the rental agreement in a situation where the lessee or contact person does not notify the lessor of any changes in their address or boat information electronically or does not follow the instructions given.
5.9. You can terminate the rental agreement yourself electronically. Termination of the boat berth also terminates the winter storage berth until the end of the current season. The berth fee paid will be refunded if the termination occurs by the last weekday of March.
5.10. Applications for boat or winter storage places managed by the City of Hamina are made using an electronic application form via the service found on the City of Hamina website. The application is seasonal. The vacated boat places are distributed seasonally after the application opens, based on the declared boat size and the harbour options presented in the application. The tenant can confirm their existing place for the next boating season annually by January

5.11. The City of Hamina may, if necessary, change the tenant's berth during the season, if the size of the boat or the conditions of the berth or marina require it.
5.12. The rental period for a boat berth begins when the payment has been received into the city's account and ends on the last day of the same year. The boating season is the period between 1.5 May and 30.9 September of each calendar year. 5.13. The tenant may, at his own risk, bring the boat to the rented berth before the start of the boating season, if the weather and natural conditions allow it, however, taking into account the completion of renovation work at the marina and any restrictions on use that may arise.
5.14. Unless otherwise agreed with the regional services of the City of Hamina, the tenant must move their boat away from the marina berth after the end of the sailing season, before the harbor freezes, but no later than December 31.12.
5.15. The City of Hamina is not responsible for any damage or injury to a boat left at or brought to the marina outside the boating season due to maintenance, repair or breakage of the marina and pier structures or mooring equipment.
5.16. The winter storage season begins in September and ends by the end of May.
Section 6 Boat and trailer berth
6.1. The City of Hamina shall assign a boat or trailer berth to the tenant. Storing the boat or trailer elsewhere is prohibited. Places managed by clubs shall be assigned by the relevant boat club. The boat/trailer on the boat berth and/or trailer berth must have an identification tag provided by the landlord entitling it to the berth. The tag must be attached to a visible location that facilitates supervision, e.g. on the windshield or control console.

6.2. The City of Hamina may transfer, without obligation, any abandoned, unauthorized item for storage.

6.3. A special permit must be displayed on the boat or trailer during temporary storage.
6.4. Storing any kind of goods, such as nets or dinghies, on the piers or other harbour areas of the marinas of the city of Hamina is prohibited. However, dinghies may be stored in areas specifically reserved for them.
6.5. At the tiller berth, the boat must be 0,4 m narrower than the nominal length of the boat berth, and at the stern buoy berth, 0,5 m narrower than the nominal length. At the tiller berth, the boat may not be longer than one meter at most than the nominal length of the tiller berth. The maximum permitted weight of a boat moored in marinas owned by the City of Hamina is 10,000 kg, the maximum permitted length
15 m and the maximum permitted width is 4,5 m. Vessels larger than this size only with permission from the regional services of the City of Hamina.
6.6. In the marinas of the city of Hamina, boats must be moored in such a way that the load caused by the mooring on the pier, boom, buoy or boat is as small as possible. The loads caused by the movements of the boats must be reduced by using a sufficient number of sufficiently effective springs in connection with the moorings.
6.7. The displacement of the buoy due to a mooring error and/or other costs of repairing damage caused by careless mooring may be invoiced in full to the person causing the damage. Two boats may not be kept side by side or in a row on a berth.
Section 7 Winter storage
7.1. The winter storage location of the boat is designated either by the City of Hamina or by a boat club authorized for each port.
7.2. A boat in winter storage must have an identification tag provided by the lessor that qualifies for winter storage. The tag must be attached to a visible location that facilitates supervision, e.g. on the bow of the boat or on the boat stand.
7.3. Masts must be stored in a mast stand if it does not fit inside the own area. Storing masts upright is prohibited. The renter must ensure that the boat in the rented winter storage place is well supported.
7.4. The renter must ensure that the protective cover is properly attached. The boat and its docking equipment must fit inside the winter storage area.
7.5. The lessee must also ensure that no danger, injury, damage or other harm is caused to the structures, equipment and facilities of the winter storage area or to other users of the area or their property. The lessee is always responsible for all damage to his boat, its winter storage equipment or other equipment owned or in his possession in Hamina.

7.6. The City of Hamina will remove docking equipment brought to the winter storage area before the start of the winter storage season from the winter storage area at the expense and responsibility of the owner of the equipment. 7.7. After June 10, docking equipment in the winter storage area is considered abandoned. The City of Hamina will remove abandoned docking equipment, either for scrapping or storage. The costs of moving, scrapping or storing will be charged to the person renting the space. The City of Hamina will move a boat that is in winter storage in an unauthorized location or without an identification, or that has been docked without a permit during the boating season, without the city having any storage obligation.
7.8. A barrier leads to the winter storage area. The gate is open all year round between 07:00 and 23:00. At other times, the storage area can be accessed with a key. The key can be obtained from the customer service of the City of Hamina (Puistokatu 2, 49400 Hamina) between 08:00 and 16:00, upon receipt of the payment.
Section 8 Storage areas
8.1. Storage areas are intended for the storage of boats and trailers.
8.2. Cars are not allowed to be stored in the boat storage area. Snow conditions may affect the use of the area in winter.
8.3. Your own storage area must be kept clean. Mixed waste must be placed in large waste containers and waste related to painting the bottoms and servicing or repairing the engines in the hazardous waste container. The door of the hazardous waste container must be kept closed. Washing the bottoms of boats is only permitted at the washing stations in front of the driving gate. In addition, occasional washing of boats must be carried out with mild detergents that do not contain hydrocarbon solvents. Wash water must not be discharged directly into the watercourse. Professional or large-scale washing of boats, machines and similar equipment or washing with detergents containing hydrocarbon solvents is only permitted at a washing station built for this purpose, the washing water of which is treated in sand and oil separation wells or other equipment suitable for the purpose and
is directed to a centralized wastewater treatment plant. Washing vehicles, boats, machines and similar equipment is prohibited in streets or road areas and other areas in public use.
8.4. When washing a boat in the water, solvents or other harmful substances must not be released into the sea or waterway. When washing docked boats and removing primer, harmful substances must be prevented from entering the soil as much as possible.
8.5. Boat grinding dust and other hazardous waste must be delivered to an appropriate collection point or treatment. Glycol used as a preservative in engine cooling systems during winter storage must be collected in the spring and treated as hazardous waste. Engines must be tested in the spring in the docking area to prevent glycol from entering the sea.
8.6. Oil changes in marinas and storage areas must be carried out on a sealed surface and in such a way that oil does not enter the soil or watercourse. Waste oil must be carefully collected and delivered to a hazardous waste container designated for oils. Sand, soda, glass, etc. blasting of boats is prohibited in marina areas. If in the marina

Section 9 Boats kept in winter storage areas during the boating season
9.1. During the boating season from 1.5 May to 30.9 September, a notification of a boat being lifted out of the water due to repairs or other compelling reasons must be submitted on the first possible weekday to the City of Hamina's Green Services, which can issue a temporary permit to dock the boat in the repair area. Docking is subject to a fee.
9.2. A weatherproof A4-sized label, available from the customer service of the City of Hamina, Rinkeli, must be attached to the boat. The label must be clearly visible.
Section 10 Measures in the event of damage and violations
10.1. If a ship or boat has sunk, is drifting or has run aground, the procedure shall be in accordance with the Water Traffic Act. In addition, the harbour authority shall be immediately notified of any incident occurring within the area covered by these marina rules.
10.2. If a vessel, boat, goods, machinery or vehicle has been placed without permission or otherwise in violation of marina regulations or in a manner that hinders traffic and the master, driver, owner or holder does not ensure its removal, it may be removed and stored by the harbour authority, using official assistance if necessary. The harbour authority has the right to charge the owner or holder for the costs incurred in the removal and storage.
10.3. If a marina's pier or other equipment is damaged due to the actions of a port user, the port authority must be notified immediately. The port authority will provide an assessment of the damage caused, to which the person who caused the damage or his representative must also be invited. The person who caused the damage is liable to compensate for the damage.
Section 11 Supplementary instructions
11.1. Exceptions and supervision
The City of Hamina may issue supplementary instructions and regulations within the framework of the marina rules. Compliance with these marina rules is monitored by the City of Hamina and the marina-specific authorized boat club.
11.2. Limitation of liability
The City of Hamina is not responsible for any damage to property or personal injury caused by storms, floods, high water levels, abnormal weather conditions or other exceptional natural conditions, or by poisons, fuels, etc. or fires in marinas and storage areas, on land or in water.
11.3. Storage and redemption
The City of Hamina is not liable for any damage to a boat, trailer or other item in storage. The boat, trailer or other item must be redeemed within 12 months of the date of recovery (cf. section 5.8). Redemption can be made by the verified owner of the item by paying the transfer and storage costs. After payment, redemption must be made within a week. The transfer and storage cost price list is available on the city's website. If boats, trailers or items are not redeemed within 12 months of recovery, the city may either scrap the recovered item or sell it. The sale will be announced separately.
11.4. Use of electricity in marinas
In marinas where electricity is available, electricity use is included in the marina fee during the boating season from 1 May to 30 September. Outside the boating season, electricity use is agreed upon separately and is also invoiced separately according to usage. The maximum current is 10 A, i.e. approximately 2,200 W. Electricity may not be used for heating boats. Extension cords used must be intended for outdoor use and installed in such a way that they do not pose a tripping or other hazard to harbor users. Electrical cords that pose a hazard or are used to heat boats are removed, and the recovered cords can be collected from the City of Hamina's green services during office hours. The City of Hamina does not pay for emergency electrical repairs ordered by the tenant, for example those carried out on weekends, unless the repairman proves that there was a real hazard involved.
11.5. Summer water
Summer water is available at the harbours of Yrjösenpohja, Hietakylä, Lepikönranta and Tervasaari. Water points are available during the boating season, depending on the weather. Care must be taken when using water and water must not be wasted.
11.6. Living on a boat
Living on a boat is strictly prohibited in the marina or storage area. Overnight stays are permitted on specially designated guest boat docks. It is not permitted to stay overnight in the winter storage area, even temporarily. Parking of motorhomes and caravans in the winter storage area is prohibited.
11.7. Renovation work
Due to maintenance work being carried out at the marina, boaters must immediately move their boat elsewhere when instructed to do so.
11.8. Disagreements
Disputes related to these port regulations shall be resolved in the Kymenlaakso District Court. The applicable law is Finnish law.
